Terms of Service - Clienteria

1. Introduction

By accessing and using Clienteria, you accept and agree to be bound by the terms and provision of this agreement. Supplementally, you shall be subject to any posted guidelines or rules applicable to such services. All such guidelines or rules are hereby incorporated by reference into the TOS.

2. Description of Service

Clienteria provides users with access to appointment scheduling, client management, and notification tools (the 'Service'). You understand and agree that the Service is provided 'AS-IS' and that Clienteria assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings.

3. Account Registration

To access certain features, you must register for an account. You agree to provide accurate and complete information. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password.

4. User Responsibilities

You agree not to use the Service to:

Upload, post, email, transmit or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
Harm minors in any way;
Impersonate any person or entity;
Forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service;

5. Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of Clienteria and its licensors. The Service is protected by copyright, trademark, and other laws of both the Ukraine and foreign countries.

6. Limitation of Liability

In no event shall Clienteria, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation, if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
